Hosting & Maintenance Terms

These Terms apply to website hosting, domain registration, email setup, maintenance and support services provided by vineyardtags.uk, trading as Vineyard & Orchard Digital ("we", "us") to the Client.
1. Service Availability
We aim for high availability but do not guarantee uninterrupted, error-free or 100% available service. Downtime may occur due to maintenance, third-party providers, internet routing, cyber-attacks or events outside our control.
2. Third-Party Providers
Hosting, domain, DNS, email and similar services are delivered using third-party infrastructure. We act as a reseller or manager of these services and are not liable for failures, outages, data loss or policy changes of those third parties. Their own terms apply alongside these Terms.
3. Backups
Where backups are included in a package, they are taken on a routine basis as a courtesy. Backups are not guaranteed to be complete, recent or restorable. The Client is responsible for keeping their own independent copies of any critical content and data.
4. Security
We apply reasonable security measures (updates, SSL, basic hardening). No system can be guaranteed secure. We are not liable for losses arising from cyber-attacks, vulnerabilities in third-party software, weak Client passwords, or unauthorised Client access.
5. Maintenance Windows
We may carry out scheduled maintenance which can briefly affect availability. Where reasonably possible, we will give advance notice.
6. Client Responsibilities
- Keep account credentials secure and confidential;
- Use the services lawfully and in line with our Acceptable Use Policy;
- Pay all hosting, domain and maintenance fees on time;
- Notify us promptly of any issues.
7. Domain Registration
Where we register or manage domains on the Client's behalf, the Client remains the legal registrant. Domain renewals are the Client's responsibility; we will use reasonable efforts to remind, but are not liable for expired or lost domains.
8. Fees & Renewals
- Hosting and maintenance are billed in advance, monthly or annually as agreed.
- Renewals occur automatically unless cancelled at least 14 days before the renewal date.
- We may revise pricing on renewal with reasonable notice.
9. Suspension
We may suspend hosting, email or related services if:
- Fees are unpaid;
- The Client breaches our Acceptable Use Policy;
- The service is being used unlawfully, abusively, or in a way that risks our infrastructure or other clients.
10. Termination & Data Export
On termination, the Client may request an export of their site files and data within 14 days. After that, we may delete the data from our systems. We are not obliged to retain or restore deleted data.
11. Limitation of Liability
Nothing limits liability that cannot be excluded by law. Subject to that:
- We are not liable for indirect, special or consequential losses, lost profit, lost data or lost business;
- Our total liability in any 12-month period is capped at the hosting/maintenance fees paid by the Client during that period.
12. Governing Law
These Terms are governed by the laws of England and Wales.
